These Terms and Conditions ("Terms") govern your use of the website operated by Shri Hari Group ("we", "us", "our") and any services, including property booking, site visits, and inquiries. By accessing our website or using our services, you agree to be bound by these Terms.
1. Eligibility
To use our services and book a property, you must:
- Be at least 18 years of age
- Have legal capacity to enter into a binding contract under Indian law
- Be an Indian citizen or a Non-Resident Indian (NRI) eligible to purchase property in India under FEMA regulations
- Provide accurate, complete, and current information
2. Acceptance of Terms
By submitting a booking application, paying a token amount, or scheduling a site visit, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and Refund & Cancellation Policy.
3. Use of Website
You agree to use our website only for lawful purposes. You will not:
- Provide false, misleading, or fraudulent information
- Use the website for unauthorized commercial purposes
- Attempt to gain unauthorized access to our systems
- Use automated scripts, bots, or scrapers
- Upload viruses, malware, or harmful code
- Violate any applicable Indian or international law
4. Property Information & Disclaimers
All property information provided on our website, including:
- Architectural renderings, 3D walkthroughs, and computer-generated images
- Floor plans, layouts, and dimensions
- Amenities, specifications, and finishes
- Price quotes and payment plans
- Project completion timelines
...are indicative only and subject to change as per actual construction, regulatory approvals, and unforeseen circumstances. The final delivered property will be governed by the registered Builder-Buyer Agreement, RERA disclosures, and approved plans by competent authorities (JDA/RERA).
5. Booking Process
The booking process consists of:
- Application: Filling the booking form on our website or at our office with KYC details
- Token Payment: Payment of the booking token amount (currently ₹25,000) via Razorpay or other approved means
- Verification: Our team verifies your application and contacts you within 48-72 hours
- Site Visit (Optional): You may schedule a site visit before/after booking
- Allotment: Upon successful verification and availability, a Letter of Allotment is issued
- Builder-Buyer Agreement: Within 30 days of allotment, a registered sale agreement must be executed
- Possession: As per project timeline and RERA registration
6. Token Amount
The booking token amount (₹25,000 or as displayed) is an Expression of Interest (EOI), not a final purchase commitment. It:
- Indicates your serious intent to book a flat
- Will be adjusted against the total property value upon successful allotment
- Does not guarantee allotment until verification is complete
- May be refunded as per our Refund Policy if allotment fails or you cancel within the permitted period
7. Pricing and Payment
- All prices are in Indian Rupees (INR/₹) and inclusive of applicable taxes unless stated otherwise
- Prices are subject to change without notice until allotment letter is issued
- Additional charges (GST, registration, stamp duty, maintenance deposit, parking) apply as per the price sheet shared at the time of allotment
- Payment plans are flexible — full payment, installments, or bank loan options available
- Failure to make scheduled payments may result in cancellation of allotment as per the agreement
8. RERA Compliance
Our projects are registered under the Real Estate (Regulation and Development) Act, 2016. Manorma Heights is registered under RERA Registration No. RAJ/P/2017/147. All project information, including approved plans, completion timelines, and disclosures, is available on the Rajasthan RERA website. You are encouraged to verify RERA details before booking.
9. Intellectual Property
All content on this website — including text, images, logos, project plans, videos, brochures, and trademarks — is the property of Shri Hari Group or its licensors and is protected under Indian Copyright and Trademark laws. You may not reproduce, distribute, or use any content without our written permission.
10. Third-Party Links and Services
Our website may link to third-party websites (RERA portal, banks, government sites) and use third-party services (Razorpay, Google Maps, WhatsApp). We are not responsible for their content, services, or privacy practices. Your use of third-party services is governed by their own terms and policies.
11. Limitation of Liability
To the maximum extent permitted by law, Shri Hari Group shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, business, data, or goodwill
- Damages arising from third-party services (payment gateways, banks, etc.)
- Force majeure events (natural disasters, pandemics, government orders, strikes)
Our total liability for any claim shall not exceed the token amount paid by you.
12. Indemnification
You agree to indemnify and hold harmless Shri Hari Group, its directors, employees, and partners from any claims, losses, damages, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party rights
- False or misleading information provided by you
13. Termination
We reserve the right to terminate or suspend your access to our website or services at any time, without prior notice, for:
- Violation of these Terms
- Suspected fraudulent or illegal activity
- Providing false information
- Non-payment of dues
14. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
15. Dispute Resolution
